An Indiana executor bond or Indiana administrator bond — together known as a probate bond or personal representative bond — is required by an Indiana court when the will provides for one, when the court finds it necessary to protect creditors, heirs, legatees, or devisees, and in nearly every case where the personal representative lives outside Indiana. Under IC 29-1-11-1, once the court orders a bond, letters will be revoked if it is not filed in time. Premiums start at $100 and are paid from estate funds.

Executor, Administrator, or Trustee — Which Indiana Probate Bond You Need

All three cover a fiduciary who manages estate or trust assets. Indiana uses “personal representative” as the umbrella term for executors and administrators, with authority granted through letters testamentary or letters of administration. Which bond applies — and whether one is required — depends on how you were appointed and where you live:

Bond Type When It Applies
Administrator Bond An Indiana administrator bond covers a personal representative appointed when there is no will, or the named executor cannot serve. The court may require bond on its own motion or on any interested person's petition whenever it finds one necessary to protect creditors, heirs, legatees, or devisees — a finding courts commonly make in intestate estates with multiple heirs. This is the most common Indiana probate bond.
Executor Bond An Indiana executor bond covers a personal representative named in a will. Bond is required when the will itself provides for one, or when the court finds it necessary. A joint-control arrangement under IC 29-1-11-2 — depositing estate funds so withdrawals require the surety's written consent or a court order — can reduce the bond exposure and premium.
Trustee Bond Required when a will establishes a trust for a beneficiary and the court requires the trustee to post security before managing trust assets. The surety reviews the trust to assess the trustee's responsibilities.

When Does an Indiana Court Require a Bond?

Probate in Indiana is governed by the Indiana Probate Code, IC Title 29, with jurisdiction in the Circuit Court of each of the 92 counties (Superior Courts share probate jurisdiction in many counties, and St. Joseph County has Indiana's only standalone Probate Court). Indiana runs opposite to most states: under IC 29-1-11-1, a personal representative is not required to file a bond unless the will provides for one or the court — on its own motion or an interested person's petition — finds a bond necessary to protect creditors, heirs, legatees, or devisees. Once ordered, the bond runs to the State of Indiana for the benefit of interested persons, with sureties jointly and severally liable.

The big exception is residency: under IC 29-1-10-1, a nonresident may qualify as personal representative only by filing a bond of at least the probable value of the estate's personal property plus estimated rents and profits during administration — so out-of-state executors and administrators should plan on a bond even when the will waives one. The same no-bond default carries into unsupervised administration under IC 29-1-7.5-2.5. If the representative causes a loss, valid claims are paid from the bond, and the representative must reimburse the surety. The bond protects the estate, not the representative.

How Your Bond Amount Is Set — and How to Reduce It

When the court orders a bond, it fixes the amount under IC 29-1-11. For nonresident representatives, IC 29-1-10-1 supplies the formula: not less than the probable value of the estate's personal property plus estimated rents and profits during probate, and not more than the probable gross value of the estate — with the court able to increase, decrease, or waive it in unsupervised administration.

Indiana also offers a joint-control premium-saver: under IC 29-1-11-2, the representative and surety can agree to deposit estate money and assets in a court-approved bank or depository so that withdrawals require the surety's written consent or a court order — reducing the risk the bond covers and, with it, the cost. The court approves the final figure; wait for it before purchasing.

Which Indiana Court Handles Your Probate

Probate jurisdiction sits in the Circuit Court of each of Indiana's 92 counties, with Superior Courts exercising concurrent probate jurisdiction in many counties and St. Joseph County operating a standalone Probate Court. Filings go through the county Clerk of Courts, and estates run as supervised administration (court approval of transactions) or unsupervised administration under IC 29-1-7.5 (available when the heirs consent or the will authorizes it, with the same bond rules). The directory below lists every county's courts page with the clerk's phone and mailing address.

How To Get Your Indiana Probate Bond

  1. Get appointed and confirm whether bond is required. Determine under IC 29-1-11-1 whether the will provides for bond or the court requires one — nonresident representatives should expect a bond under IC 29-1-10-1. The court fixes the amount; wait for the figure before purchasing.
  2. Request your quote. Apply online or call with your court documentation. For most standard estates we can quote from the bond amount alone; larger or more complex estates may involve a review of the will and the applicant's credit.
  3. Complete the short application. Provide the personal representative's information and the estate details.
  4. File your bond and receive your letters. We execute the bond with the surety's Power of Attorney attached so you can file it with the clerk. The court then issues your letters testamentary or letters of administration, and you can begin settling the estate.

Frequently Asked Questions

What is an Indiana administrator or executor bond?
A probate bond required by an Indiana court under IC 29-1-11-1 when the will provides for one or the court finds it necessary to protect creditors, heirs, legatees, or devisees. It runs to the State of Indiana and guarantees faithful discharge of the representative's duties.

Can the bond be waived?
Indiana's default is no bond at all — one is required only when the will provides for it, the court orders it, or the representative is a nonresident. Once ordered, though, it cannot be skipped: failure to file within the time fixed revokes the letters.

Do administrators need a bond in Indiana?
Only when the court finds one necessary — but courts commonly do in intestate estates with multiple heirs or unsecured creditors, and every nonresident administrator must post bond under IC 29-1-10-1 with the statutory personal-property-plus-rents formula.

How much does an Indiana probate bond cost?
Premiums start at $100 for a $10,000 bond and scale with the court-fixed amount — $135 at $25,000, $260 at $50,000, $460 at $100,000, and up. The premium is paid from estate funds.

How is the bond amount determined?
The court fixes it when ordering the bond. For nonresidents, the statute sets the range: at least the probable personal property value plus estimated rents and profits during probate, and no more than the estate's probable gross value.

Can the amount be reduced?
Yes. A joint-control agreement under IC 29-1-11-2 — depositing estate funds so withdrawals need the surety's consent or a court order — reduces the exposure, and in unsupervised administration the court can decrease or waive a nonresident's bond.

Which Indiana court handles probate?
The Circuit Court of each of the 92 counties, with Superior Courts sharing probate jurisdiction in many counties and St. Joseph County's standalone Probate Court. Estates run supervised or unsupervised under IC 29-1-7.5.

What happens if a claim is filed against the bond?
The surety pays valid claims — from mismanagement, fraud, or failure to follow the will or Indiana law — up to the bond amount, and the personal representative must reimburse the surety in full. The bond protects the estate, not the representative.
