Probate Bonds From $100 – Set by the Court

Minnesota District Courts generally require a personal representative bond only when the will demands one, an interested person requests it, or a supervised administration calls for it. When required, the court sets the amount; premiums start at $100, paid from the estate.

A Minnesota executor bond or Minnesota administrator bond — together known as a probate bond or personal representative bond — is required by a Minnesota District Court before certain personal representatives can manage the estate of a person who has died. Minnesota follows the Uniform Probate Code: under Minn. Stat. § 524.3-603, bond is required for special administrators, when the will requires it, when an interested person demands it, or when the court orders it for the protection of interested persons in a formal proceeding. Premiums start at $100 and are paid from estate funds.

Executor, Administrator, or Trustee — Which Minnesota Probate Bond You Need

All three cover a fiduciary who manages estate or trust assets. Minnesota adopted the Uniform Probate Code, so both executors and administrators are called the “personal representative.” Which bond applies — and whether one is required at all — depends on how you were appointed and whether the probate is informal or formal:

Bond Type When It Applies
Administrator Bond A Minnesota administrator bond covers a personal representative appointed when there is no will, or the named executor cannot serve. With no will to waive bond, the court in a formal proceeding will often require one unless every interested person with an apparent interest over $1,000 files a written request that no bond be required — and any such person can later demand bond under § 524.3-605. This is the most common Minnesota probate bond.
Executor Bond A Minnesota executor bond covers a personal representative named in a will. In informal probate, no bond is required unless the will requires it or an interested person demands one. In formal proceedings, the will's waiver controls unless the court determines bond is needed for the protection of interested persons. Special administrators appointed to preserve the estate must always give bond.
Trustee Bond Required when a will establishes a trust for a beneficiary and the court requires the trustee to post security before managing trust assets. The surety reviews the trust to assess the trustee's responsibilities.

Why Does the Minnesota District Court Require a Bond?

Probate in Minnesota is governed by Chapter 524 of the Minnesota Statutes — the state's Uniform Probate Code — and is handled by the District Court in each of the 87 counties. When a person dies, someone must be appointed to pay the estate's debts and distribute what remains to the rightful heirs and devisees. That personal representative controls assets that belong to other people, and the bond is the financial safeguard against mismanagement. Under § 524.3-603, bond is required of every special administrator, whenever the will itself requires it, and whenever the court in a formal proceeding determines it is needed to protect interested persons.

Minnesota also puts the power to demand protection directly in the hands of the family and creditors: under § 524.3-605, any person with an apparent interest over $1,000 — or any creditor with a claim over $1,000 — can file a written demand that the personal representative give bond. Once the demand is filed, the representative must stop exercising the powers of office (except to preserve the estate) until bond is posted, and failure to furnish it within 30 days is cause for removal. If the representative causes a loss, valid claims are paid from the bond, and the representative must reimburse the surety. The bond protects the estate, not the representative.

How the Court Sets Your Bond Amount — and How to Reduce It

When bond is required, the amount is set by the will, by court order, or by the court — Minnesota's version of the UPC has no sworn-statement formula, so you wait for the court's figure rather than calculating your own. Under § 524.3-604, the court confirms the bond is executed by a corporate surety or by individual sureties backed by adequate security, and the bond is filed with the court before letters issue.

The amount can move during administration. The court may permit the bond to be reduced by the value of estate assets deposited with a domestic financial institution in a manner that prevents their unauthorized disposition — the restricted-asset technique that materially lowers premiums on larger estates. And on its own motion, or on petition of the personal representative or any interested person, the court may excuse the requirement, increase or reduce the amount, release sureties, or permit substitution of another bond.

Informal vs. Formal Probate in Minnesota

Minnesota offers two probate tracks, and the bond rules differ between them. Informal probate is an application to the probate registrar, unsupervised by a judge — no bond is required unless a special administrator is appointed, the will requires bond, or an interested person demands one. Formal probate is a petition heard by a District Court judge (with supervised administration as its fully court-monitored form) — there, the will's waiver or the unanimous written request of $1,000+ interested persons avoids bond, unless the court determines one is required for the protection of interested persons. Probate is filed with the District Court in the county where the decedent was domiciled; larger counties such as Hennepin and Ramsey operate dedicated probate divisions.

How To Get Your Minnesota Probate Bond

  1. Get appointed and confirm whether bond is required. The court or registrar determines whether bond is required under Minn. Stat. § 524.3-603 — and if so, the court sets the amount. Wait for this figure before purchasing; in informal probate you may not need a bond at all.
  2. Request your quote. Apply online or call with your court documentation. For most standard estates we can quote from the bond amount alone; larger or more complex estates may involve a review of the will and the applicant's credit.
  3. Complete the short application. Provide the personal representative's information and the estate details.
  4. File your bond and receive your letters. We execute the bond with the surety's Power of Attorney attached so you can file it with the District Court. The court then issues your letters testamentary or letters of general administration, and you can begin settling the estate.

Frequently Asked Questions

What is a Minnesota administrator or executor bond?
A probate bond required by a Minnesota District Court under Minn. Stat. § 524.3-603 before certain personal representatives can manage a deceased person's estate. It guarantees faithful performance and protects the estate's heirs, devisees, and creditors.

Can the bond be waived?
Often. In informal probate no bond is required unless the will requires it or an interested person demands one. In formal proceedings, the will can waive it, or all interested persons with interests over $1,000 can request in writing that none be required — but the court can still order bond for the protection of interested persons.

Do administrators need a bond in Minnesota?
Frequently, in formal proceedings. With no will to waive it, the court often requires bond of an administrator unless all substantial interested persons request otherwise — and any interested person or creditor with more than $1,000 at stake can demand bond at any time under § 524.3-605. Special administrators must always give bond.

How much does a Minnesota probate bond cost?
Premiums start at $100 for a $10,000 bond and scale with the court-set amount — $135 at $25,000, $260 at $50,000, $460 at $100,000, and up. The premium is paid from estate funds.

How is the bond amount determined?
By the will, a court order, or the court. Minnesota's statute has no fixed formula — the court sets the figure, so wait for it before purchasing.

Can the amount be reduced?
Yes. Under § 524.3-604 the court may reduce the bond by the value of estate assets deposited with a domestic financial institution under restrictions preventing unauthorized disposition, and may otherwise reduce, excuse, or permit substitution of the bond on petition.

Which Minnesota court handles probate?
The District Court in each of Minnesota's 87 counties, filed in the county where the decedent was domiciled. Informal probates go through the probate registrar; formal probates are heard by a judge, and larger counties operate dedicated probate divisions.

What happens if a claim is filed against the bond?
The surety pays valid claims — from mismanagement, fraud, or failure to follow the will or Minnesota law — up to the bond amount, and the personal representative must reimburse the surety in full. The bond protects the estate, not the representative.
