Executor, Administrator, or Trustee — Which North Carolina Probate Bond You Need

All three cover a fiduciary who manages estate or trust assets. North Carolina uses “personal representative” as the umbrella term for executors and administrators, and a temporary fiduciary called a “collector” must also qualify and give bond. Which one applies — and whether a bond is required at all — depends on how you were appointed and where you live:

Bond Type When It Applies
Administrator Bond A North Carolina administrator bond is required when there is no will, or the named executor cannot serve, and the clerk appoints an administrator. A resident administrator can be excused only if every heir is 18 or older and files a written waiver — and that exception is limited to North Carolina residents, so a nonresident administrator needs a bond even if all heirs waive. This is the most common North Carolina probate bond.
Executor Bond A North Carolina executor bond applies when the deceased left a will naming an executor. A resident executor serves without bond unless the will expressly requires it. A nonresident executor is excused only if the will excuses bond and the executor appoints a resident agent for service of process — or serves alongside a bonded resident coexecutor. Otherwise, bond is required before letters testamentary issue.
Trustee Bond Required when a will establishes a trust for a beneficiary and the court requires the trustee to post security before managing trust assets. The surety reviews the trust to assess the trustee's responsibilities.

Why Does North Carolina Require a Bond?

Estate administration in North Carolina is governed by Chapter 28A of the General Statutes, and probate is handled by the Clerk of Superior Court, who serves as ex officio judge of probate in each of the state's 100 counties (N.C.G.S. § 28A-2-1). When a person dies, someone must be appointed to pay the estate's debts and distribute what remains to the rightful heirs and devisees. That personal representative controls assets that belong to other people, and the bond is the financial safeguard against mismanagement. Under § 28A-8-2, the bond is payable to the State for the use of all persons interested in the estate, conditioned on faithful execution of the trust and obedience to court orders.

The exceptions in § 28A-8-1(b) mostly protect residents: resident executors (unless the will requires bond), a personal representative who is the sole recipient of the entire estate, resident administrators when all adult heirs file written waivers, licensed trust institutions, and appointments made solely for wrongful-death actions. The practical effect is that nonresident personal representatives generally must post bond. If the representative causes a loss, valid claims are paid from the bond, and the representative must reimburse the surety. The bond protects the estate, not the representative.

How the Clerk Sets Your Bond Amount — and How to Keep It Down

Under N.C.G.S. § 28A-8-2, the amount is driven by the estate's personal property only — real estate is excluded. With a corporate surety, the bond is not less than 1.25 times the value of the personal property (and where personal property exceeds $100,000, the clerk may accept the value plus 10%). With personal sureties or deposited security, the amount doubles to twice the personal property value — another reason a licensed corporate surety is usually the economical choice.

The clerk can revisit the figure during administration: § 28A-8-3 allows the clerk to require an increased bond if the existing security becomes inadequate, or to reduce the bond on the personal representative's petition (but not below the statutory minimums). Additional bond is required before certain sales of real estate to pay debts. Wait for the clerk's figure before purchasing.
