A North Carolina executor bond or North Carolina administrator bond — together known as a probate bond, personal representative bond, or fiduciary bond — is required before the Clerk of Superior Court issues letters to a personal representative, unless a statutory exception applies. Under N.C. Gen. Stat. § 28A-8-1, every personal representative must give bond before letters are issued — resident executors are the main exception, while out-of-state representatives almost always need one. Premiums start at $100 and are paid from estate funds.

Executor, Administrator, or Trustee — Which North Carolina Probate Bond You Need
All three cover a fiduciary who manages estate or trust assets. North Carolina uses “personal representative” as the umbrella term for executors and administrators, and a temporary fiduciary called a “collector” must also qualify and give bond. Which one applies — and whether a bond is required at all — depends on how you were appointed and where you live:
| Bond Type | When It Applies |
|---|---|
| Administrator Bond | A North Carolina administrator bond is required when there is no will, or the named executor cannot serve, and the clerk appoints an administrator. A resident administrator can be excused only if every heir is 18 or older and files a written waiver — and that exception is limited to North Carolina residents, so a nonresident administrator needs a bond even if all heirs waive. This is the most common North Carolina probate bond. |
| Executor Bond | A North Carolina executor bond applies when the deceased left a will naming an executor. A resident executor serves without bond unless the will expressly requires it. A nonresident executor is excused only if the will excuses bond and the executor appoints a resident agent for service of process — or serves alongside a bonded resident coexecutor. Otherwise, bond is required before letters testamentary issue. |
| Trustee Bond | Required when a will establishes a trust for a beneficiary and the court requires the trustee to post security before managing trust assets. The surety reviews the trust to assess the trustee's responsibilities. |
Why Does North Carolina Require a Bond?
Estate administration in North Carolina is governed by Chapter 28A of the General Statutes, and probate is handled by the Clerk of Superior Court, who serves as ex officio judge of probate in each of the state's 100 counties (N.C.G.S. § 28A-2-1). When a person dies, someone must be appointed to pay the estate's debts and distribute what remains to the rightful heirs and devisees. That personal representative controls assets that belong to other people, and the bond is the financial safeguard against mismanagement. Under § 28A-8-2, the bond is payable to the State for the use of all persons interested in the estate, conditioned on faithful execution of the trust and obedience to court orders.
The exceptions in § 28A-8-1(b) mostly protect residents: resident executors (unless the will requires bond), a personal representative who is the sole recipient of the entire estate, resident administrators when all adult heirs file written waivers, licensed trust institutions, and appointments made solely for wrongful-death actions. The practical effect is that nonresident personal representatives generally must post bond. If the representative causes a loss, valid claims are paid from the bond, and the representative must reimburse the surety. The bond protects the estate, not the representative.
How the Clerk Sets Your Bond Amount — and How to Keep It Down
Under N.C.G.S. § 28A-8-2, the amount is driven by the estate's personal property only — real estate is excluded. With a corporate surety, the bond is not less than 1.25 times the value of the personal property (and where personal property exceeds $100,000, the clerk may accept the value plus 10%). With personal sureties or deposited security, the amount doubles to twice the personal property value — another reason a licensed corporate surety is usually the economical choice.
The clerk can revisit the figure during administration: § 28A-8-3 allows the clerk to require an increased bond if the existing security becomes inadequate, or to reduce the bond on the personal representative's petition (but not below the statutory minimums). Additional bond is required before certain sales of real estate to pay debts. Wait for the clerk's figure before purchasing.
The Clerk of Superior Court Is Your Probate Court
North Carolina has no separate probate court: the Clerk of Superior Court in each of the 100 counties is ex officio judge of probate, with jurisdiction over the administration, settlement, and distribution of decedents' estates. You qualify, file your bond, and receive your letters through the clerk's estates division at the county courthouse. The directory below lists every county's courthouse with its website, phone number, and mailing address.
How To Get Your North Carolina Probate Bond
- Get appointed and receive your bond amount. The Clerk of Superior Court determines whether bond is required under N.C.G.S. § 28A-8-1 and sets the amount from the estate's personal property during qualification. Wait for this figure before purchasing — you may also learn you qualify for an exception.
- Request your quote. Apply online or call with your court documentation. For most standard estates we can quote from the bond amount alone; larger or more complex estates may involve a review of the will and the applicant's credit.
- Complete the short application. Provide the personal representative's information and the estate details.
- File your bond and receive your letters. We execute the bond with the surety's Power of Attorney attached so you can file it with the Clerk of Superior Court. The clerk then issues your letters testamentary or letters of administration, and you can begin settling the estate.

Frequently Asked Questions
What is a North Carolina administrator or executor bond?
A probate bond required under N.C. Gen. Stat. § 28A-8-1 before the Clerk of Superior Court issues letters to a personal representative. It guarantees faithful execution of the trust and protects the estate's heirs, devisees, and creditors.
Can the bond be waived?
For residents, often. Resident executors serve without bond unless the will requires it, a sole-recipient representative is exempt, and a resident administrator is excused when all adult heirs file written waivers. Nonresident personal representatives generally must post bond — the heir-waiver exception does not extend to them.
Do administrators need a bond in North Carolina?
Usually. An administrator must give bond before letters of administration issue unless every heir is 18 or older, files a written waiver, and the administrator is a North Carolina resident. Nonresident administrators need a bond even when all heirs waive.
How much does a North Carolina probate bond cost?
Premiums start at $100 for a $10,000 bond and scale with the required amount — $135 at $25,000, $260 at $50,000, $460 at $100,000, and up. The premium is paid from estate funds.
How is the bond amount determined?
Under N.C.G.S. § 28A-8-2, the amount is based on the estate's personal property only — not less than 1.25 times its value with a corporate surety, or double with personal sureties. Real estate is excluded from the calculation.
Can the amount be reduced?
Yes. The clerk may reduce the bond on the personal representative's petition under § 28A-8-3, though not below the statutory minimums, and using a corporate surety instead of personal sureties substantially lowers the required amount in the first place.
Which North Carolina court handles probate?
The Clerk of Superior Court in each of the state's 100 counties — North Carolina has no separate probate court. The clerk serves as ex officio judge of probate and handles qualification, bonds, and letters through the estates division.
What happens if a claim is filed against the bond?
The surety pays valid claims — from mismanagement, fraud, or failure to follow the will or North Carolina law — up to the bond amount, and the personal representative must reimburse the surety in full. The bond protects the estate, not the representative.
