Why Do I Need a Pennsylvania Manufacturer of ENDS Products Bond?
The Pennsylvania Manufacturer of ENDS Products Bond — also known as the Pennsylvania vape directory bond, Pennsylvania ENDS surety bond, or Pennsylvania electronic nicotine delivery systems bond — is a new requirement under Act 57 of 2025 (House Bill 1425), effective February 20, 2026. Every manufacturer of electronic nicotine delivery systems (ENDS) products that sells or offers products for retail sale in the Commonwealth of Pennsylvania must obtain this surety bond as part of their certification with the Pennsylvania Office of Attorney General.
Under Act 57 of 2025, the Pennsylvania Attorney General maintains a state-managed ENDS directory — the Pennsylvania Vape Directory — listing all approved ENDS manufacturers and products that may legally be sold in the Commonwealth. To be included on the directory, manufacturers must submit a certification to the Attorney General along with a surety bond payable to the Commonwealth of Pennsylvania in a minimum amount of $50,000. The Attorney General may require a higher bond amount in certain circumstances. ENDS products not appearing on the directory are subject to seizure by the Commonwealth beginning October 19, 2026, and manufacturers face penalties of up to $1,000 per violation per product.
The bond must be renewed annually. Manufacturers must submit a new certification to the Attorney General by April 21 of each year to remain on the Pennsylvania ENDS directory.

How To Get Certified as a Pennsylvania ENDS Manufacturer
Under Act 57 of 2025, every ENDS manufacturer selling products in Pennsylvania must be certified by the Pennsylvania Office of Attorney General and listed on the Pennsylvania Vape Directory. The certification deadline for initial inclusion on the directory was April 21, 2026. Annual recertification is due by April 21 of each subsequent year. Below are the key steps in the certification process.
- Confirm your products require certification. The Pennsylvania ENDS directory requirement applies to all electronic nicotine delivery systems (ENDS) including e-liquid, e-liquid cartridges, e-liquid pods, and disposable products that contain nicotine. It also applies to electronic cigarettes that do not contain nicotine if they use the same brand name as a nicotine-containing product. Products must have either received FDA marketing authorization or have a pending Premarket Tobacco Product Application (PMTA) submitted by September 9, 2020.
- Obtain your $50,000 Pennsylvania ENDS surety bond. A surety bond payable to the Commonwealth of Pennsylvania in a minimum amount of $50,000 must be submitted as part of your certification. The Attorney General may require a higher bond amount. BondAbility can provide a personalized quote promptly — credit review required.
- Prepare your certification package. Your certification to the Pennsylvania Attorney General must include the bond documentation (bond amount, bond number, effective date, surety name, phone number, and email address, with a copy of the bond attached), FDA records, packaging images with UPCs, brand lists, manufacturer and importer information, Pennsylvania tobacco license materials where applicable, ownership and officer information, and other required documentation as specified in the ENDS Directory Instructions (Form TES-025).
- Submit your certification. Submit your completed certification package to the Pennsylvania Office of Attorney General, Tobacco Enforcement Section at www.attorneygeneral.gov/ends/. Do not use the cigarette certification link — a vape certification submitted on a cigarette form will be rejected.
- Renew annually by April 21. Manufacturers must submit a new certification and updated bond to the Attorney General by April 21 of each year to remain on the Pennsylvania ENDS directory. Failure to recertify may result in removal from the directory and products becoming subject to seizure.
