On June 20, 2025, Texas enacted SB 140< to broaden and modernize its telephone-solicitation rules with the goal of strengthening consumer protections. Beginning September 1, 2025, “telephone solicitations” explicitly include outreach via SMS/text messaging, meaning many companies’ text-marketing programs are now treated like traditional telemarketing under Texas law. Texas requires telephone solicitors to register with the Secretary of State and maintain a surety bond as part of that registration. The bond helps ensure compliance with Chapter 302 of the Texas Business & Commerce Code and provides recourse if a solicitor violates the statute.
